ERS European Rendering Solutions UG (hereinafter “ERS” or “we”) takes the protection of your personal data seriously. Any personal data (e.g. the name, address, e-mail address or telephone number of a person [such person hereinafter referred to as the “Data Subject”]) is processed exclusively in accordance with the EU General Data Protection Regulation (hereinafter “GDPR”) and the country-specific data protection provisions applicable to ERS.

3. PROCESSING OF USAGE DATA

The Website collects general data and information of its users stored on a third-party provider (“Wix XXX”). This concerns the following data:

  • Browser types and versions used,

  • Operating system used by the accessing system,

  • Webpage from which an accessing system arrived on this Website (known as a referrer),

  • Sub-websites that are accessed on this Website via an accessing system,

  • Date and time of an access to the Website,

  • IP address,

  • Internet service provider of the accessing system

  • Other data and information aimed at averting danger in the event of attacks directed at our IT systems

When processing this usage data, ERS does not draw any conclusions as to the Data Subject

 

ERS requires this data to

  • Correctly deliver content,

  • Optimize content and advertising,

  • Ensure the functionality of our IT systems and connected third party applications

  • Provide law-enforcement authorities the information necessary for purposes of conducting criminal proceedings

The legal basis for this processing activity is Art. 6(1)(f) GDPR.
Data is analysed in an anonymised form by ERS statistically with the aim of enhancing data protection and data security.

4. PROCESSING OF PROVIDED DATA

ERS collects and stores data provide to us by you when using the Website

Such data includes:

  • Information of registration process or upon signing up for one of our services, such as name, email address, telephone number, mobile phone number

  • Data that you provided to us by you entering into a purchase contract regarding a visualization;

  • The legal basis for this processing activity is Art. 6 (1)(b) GDPR

  • Data transmitted in context of finding solution to problems and of correspondence/feedback on the Website or via email / fax / postal mail / telephone;

  • additional personal data which we request from you and which we need for the authentication

5. PERSONAL DATA TRANSFER TO EXTERNAL / THIRD-PARTY SERVICE PROVIDERS

ERS requires assistance from external service providers for technical several technical programs (e.g. but not exclusively data analysis, processing or storage processes). Service providers are selected with utmost attention and meet data protection and security standards. Such providers are required to maintain strict confidentiality and process personal data only when commissioned to do so by ERS and according to ERS‘s instructions. The legal basis of such service providers is Article 28 GDPR.

ERS cooperates with companies and other entities which provide specialized expertise with regard to special areas (e.g. tax consultants, legal counsel, accounting firms, logistics companies). These entities are either legally or contractually obliged to maintain confidentiality. If a transmission of personal data to these entities is necessary, the legal basis is, depending on the respective kind of cooperation, Article 6(1)(b) or, (f) GDPR.

6. NEWSLETTER SIGN-UP

Signing up for newsletter, we use your e-mail address to send our newsletter, through which we regularly provide information about topics and offers. IP address, the date and time of the newsletter sign-up and the confirmation will be stored to track and produce evidence of the sign-up at a later date. We store your e-mail address to send newsletter unless and until you unsubscribe. For statistical analyses of our newsletter campaigns, the newsletters contain what is known as tracking pixels. This thumbnail graphic embedded in the e-mail formatted in HTML allows to detect whether and when you have opened an e-mail and which links contained within the e-mail were clicked on. As part of this process, your IP address, too, is transmitted to third-party servers. We do not, however, store this IP address nor do we store any other personal data. The legal basis for this processing activity is your consent according to Art. 6(1)(a) GDPR. At any time, withdrawal of your consent with effect for future to any types of newsletters without incurring any costs other than base rate transmission costs (i.e., for example, the costs of your internet service provider) is possible.

In case of withdrawal request, we add respective personal contact data to blocking lists. Legal basis for processing activity is Art. 6(1)(f) GDPR.

7. COOKIES

The Website uses cookies. Cookies mean text files placed and stored on a computer system via browser. Cookies are stored on the hard drive of the user’s computer without any adverse effects. Cookies of the Website contain personal data about the user. Cookies save user of Website trouble of, e.g., having to repeat data, decreasing time to identify users. Among other, this helps ERS to adjust Website contents to needs of users. Legal basis for processing activity is Art. 6(1)(f) GDPR. Users may, at any time, prevent Website from creating any cookies by making corresponding adjustment to internet browser settings, and permanently reject cookies.

8. GOOGLE ANALYTICS

Website uses Google Analytics, a web-analytics service. Web analytics is collection, compilation and analysis of data regarding the behaviour of online page’s visitors.

The operating company of the Google-Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

 GoogleLLC has been certified under Privacy-Shield framework and offers a guarantee that it is in compliance with European data protection law https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active

Technical process enables Google, among other, to trace visitors and clicks. Each time our Website is visited, personal data, including the IP address of the internet connection used by the Data Subject, is transferred to Google in the US. This personal data is stored by Google in the US.

Google may transfer personal data to third parties. In order to prevent Google to do this, the Data Subject needs to download a browser add-on at https://tools.google.com/dlpage/gaoptout and install it. This browser add-on requires Google Analytics via JavaScript to not transmit data to Google Analytics. 9. GOOGLE TAG MANAGER

Website uses Google Tag Manager. Service allows website tags to be managed via interface. Tags equal small code elements serving, among other, to measure traffic and visitor behaviour. Google Tag Manager only implements tags and does not use any type of cookies (No personal data is stored). The service triggers other tags and collect data. Google Tag Manager does not access this data.

10. ERASURE AND BLOCKING OF PERSONAL DATA

ERS processes and stores personal data only for certain among of time as required in order to achieve the purpose of storing data. Once purpose ceased, personal data is erased or anonymized as routine and in accordance with legal provisions. Usage data is generally erased after 30 days.

11. RIGHTS OF THE DATA SUBJECT

Data subjects may ask to exercise any of the rights listed in this clause:

  1. Right to confirmation (request if personal data is processed)

  2. Right of rectification (request to correct falsely collected data)

  3. Right of erasure (request to erase personal data without unnecessary delays)
